Terms of Service

1. The Service

Homeward Japan is a property research and discovery platform. It aggregates publicly available real-estate listing information from third-party sources across Japan (including municipal vacant-house registries), translates and summarizes that information using automated and AI-assisted processes, and presents supplementary analysis such as estimated natural-hazard exposure, accessibility, and lifestyle suitability scores (together, "Content").

We are not a real-estate broker, agent, or advisor. Nebula 500 is not a licensed real-estate brokerage in Japan, Canada, or any other jurisdiction. The Service does not create an agency, brokerage, advisory, or fiduciary relationship. We do not list, sell, offer, or broker any property, and nothing on the Service constitutes an offer to sell or a solicitation to buy real estate, nor legal, financial, tax, immigration, or investment advice. Any transaction you pursue is solely between you and the relevant seller, agent, or authority, and you are responsible for engaging qualified licensed professionals.

2. No Warranty on Listings, Translations, or Scores

Content is provided for general informational purposes only. Listings originate from third-party sources that we do not control; they may be outdated, incomplete, inaccurate, or withdrawn without notice. Translations, summaries, risk assessments (including flood, landslide, earthquake, and snowfall indicators), and suitability scores are generated in whole or in part by artificial intelligence and may contain errors. You must independently verify all information — including price, availability, boundaries, legal status, zoning, land-use restrictions (such as Japan's Agricultural Land Act), and hazard exposure — with primary sources and qualified professionals before making any decision.

3. Accounts

Certain features require an account. You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. You must be at least 18 years old. We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk or legal exposure for us.

4. Subscriptions, Fees, and Metered Usage

Parts of the Service, including AI-powered search, are paid features offered on a subscription basis plus metered usage fees based on your consumption of AI processing. We record your usage and associated costs. Fees, billing intervals, and included allowances will be presented at the point of purchase and may change with reasonable notice. Except where required by law, fees are non-refundable. We may suspend paid features for non-payment.

5. Acceptable Use

You agree not to:

• scrape, harvest, bulk-download, or systematically extract Content from the Service, or use the Service to build a competing dataset or product;
• circumvent access controls, rate limits, or metering;
• use the Service for unlawful purposes or to infringe the rights of others;
• submit malicious content or interfere with the operation of the Service;
• resell, sublicense, or redistribute Content without our prior written consent; or
• misrepresent Content as an official listing, offer, or government record.

6. Intellectual Property

The Service — including its software, design, compiled databases, translations, summaries, scores, and branding — is owned by Nebula 500 or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial property research. Underlying listing facts remain the property of their respective sources; third-party trademarks belong to their owners.

7. Third-Party Sources and Links

The Service links to and derives Content from third-party websites and public data sources. We are not responsible for their availability, accuracy, or practices. Your dealings with any third party, including property sellers and municipal programs, are solely between you and that third party.

8. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT IS ACCURATE, CURRENT, OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEBULA 500, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE OR ANY CONTENT — INCLUDING ANY PROPERTY DECISION, PURCHASE, OR TRANSACTION MADE IN RELIANCE ON THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE AND (B) CAD $100. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Nebula 500 and its directors, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Changes to the Service and Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time; the "Last updated" date above reflects the current version. Material changes will be communicated by reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in British Columbia, Canada for any dispute arising out of or relating to these Terms or the Service, and you waive any objection to venue in those courts. Nothing in this section deprives you of mandatory consumer protections available in your jurisdiction of residence.

13. General

These Terms constitute the entire agreement between you and Nebula 500 regarding the Service. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
